-3- <br />Comments on Findings <br />I. Legal, Financial and Compliance Information - Rule 2.03 <br />The life-of-mine permit term requested in the original permit was <br />denied by the Division, however, all disturbances included in the <br />life-of-mine plan have been approved. These disturbances will be <br />implemented through successive renewal of 5-year terms. <br />During the review process the BLM required Colowyo to obtain a permit <br />fora 2-acre parcel located on Streeter Fill. Colowyo is in the <br />process of obtaining this permit. In addition, it was determined by <br />OSM that the Federal permit issued in 1982 did not need to be renewed, <br />due to subsequent approval of the State program. OSM has also <br />verified that Colowyo has paid all required reclamation fees to date. <br />The operation received only one violation during the previous permit <br />term, and continues to be in compliance with the requirements of this <br />section. <br />II. Land Use - Rules 2.04.3, 2.03.5, and 4.16 <br />There is no change in the land use sections of the permit. The <br />operation will return the site to the pre-mining land use of rangeland <br />-- and wildlife habitat, and is in compliance with the requirements of <br />this section, <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />In the original permitting process it was felt by OSM that more data <br />was needed on 3 sites identified in the archeological survey. As a <br />result, a stipulation was written into the OSM approval, This <br />stipulation has been satisfied (see Exhibit 5). The operation is in <br />compliance with the requirements of this section. <br />IV. Geology - Rules 2.04,5 and 2.04.6(1) <br />There have been no changes in the baseline geology data for the mine. <br />The original review did identify some problems with sampling <br />intensity, and the presence of some sodic interburden strata. As a <br />result a monitoring program was set up which requires the operator to <br />sample overburden from the X and Y seams using blast hole cuttings. <br />The operator also samples regraded spoil at an intensity of one sample <br />per 5 acres. The sampling program is discussed in more detail on page <br />2.05-10, Minor revisions O1 and 03 have been incorporated into this <br />plan. <br />
