<br />Dan Mathews - 2 - December 27, 1999 <br />would resolve all environmental issues for the use of the site, including final <br />reclamation, or <br />2. any other mechanism which would allow gravel mining prior to the release of the <br />coal bond 10 years after reclamation. <br />A similar situation occurred at the North Thompson Creek Mine loadout, permit C-81-025. <br />Pertinent facts regarding this release follow: <br />1. The loadout was constructed on an alluvial valley floor. <br />2. The loadout was reclaimed and the essential hydrologic function of flood irrigation <br />was restored during 1987. <br />3. Vegetation was sampled at the loadout in late 1991. Based on this study it was <br />determined the reclaimed loadout had a ground cover of living plants adequate to <br />control erosion. <br />4. The Garfield County Commissioners approved rezoning at the loadout and <br />surrounding area for the Aspen Glen Planned Unit Development during1992. <br />5. The Operator changed the postmining land use at the loadout from agriculture to <br />residential during 1992. <br />6. The bond was released in 1993 after commencement of construction activities for <br />the postmining land use. <br />7. The loadout was removed from the permit in early1994. <br />The change in postmining land use at the North Thompson Creek Mine loadout was not <br />anticipated when reclamation occurred. Therefore, steps two and three were performed. <br />We would like to skip steps two and three and obtain bond release after commencement <br />of construction activities for the gravel mining postmining land use. Reclamation of <br />structures at the loadout could be covered under the new gravel mining 112 permit. Even <br />if negotiations with Elam break down, Powderhorn plans to pursue approval of gravel <br />mining in the loadout area. We realize your response to this question may involve some <br />investigation.
