Mr. John Whitley <br />Mr. Neal Starkebaum <br />Page 2 of 8 <br />July 27, 2007 <br />5) materials from the street job were transported and dumped at the Schmalz property <br />After some lively discussion, Mr. Whitley and 1 drove to the Schmalz property to observe the <br />site. We did not enter the property, but rather drove and walked around three sides of the <br />property. The site is located about one-half mile uphill from the Whitley's; other residences aze <br />between the two subject properties. No elevated gamma exposure rates were noted. The site <br />was in good condition, with no apparent discolored soil, no drums, refuse, or any indication of an <br />environmental crime. There were quite a few old vehicles and storage trailers, sheds, and an <br />abandoned tank on the property. It did not appear that gravel mining had been occurring <br />recently. See attached pictures. It appeared that there had been material dumped and leveled in <br />the recent past. It did not look to me like enough material to be from an excavation that was 8 <br />feet deep and three city blocks long. <br />After leaving the site, I dropped Mr. Whitley off at his house and went to the County offices. I <br />met with Richard Stenson, a County environmental health official who has dealt with Rusty over <br />the years and has a level of trust with him. Mr. Stenson and I discussed the situation and <br />allegations, He provided an objective overview of the relationship between Rusty and the <br />County and City officials, and how it has developed over the last 30 plus years, as well as some <br />of the specifics of the allegations. Mr. Stenson and I tried to reach Mr. Schmalz to gain access to <br />the property, but by that time it was afrer 6:00 PM, and we didn't get him. <br />On July 18, I received a call from the Assistant County Planner, Neal Starkebaum. He was very <br />interested in my investigation and these allegations and wanted me to return as soon as possible <br />to make the measurements on the Schmalz property. <br />On the morning of July 19, 2007, I returned to Gunnison. I met with Mr. Starkebaum in his <br />office and we then went to the Schmalz property, where the owner, Fred Schmalz met us. I <br />made some gamma exposure rate measurements over the piles of material. No elevated gamma <br />measurements were present. A]l the material was at background. I showed the gentleman the <br />instrument response using a lantern mantle. <br />Once we were done with the site visit, l took Mr. Starkebaum back to his office. I then met <br />briefly with the City Manager, Ken Coleman to get his input and brief him on why I was there. I <br />finally left Gunnison around 1:00 PM. <br />After returning to the office, I followed up with a call to the state inspector for the gravel <br />operations. <br />My findings and conclusions are as follows: <br />1). Allegation: The property is not currently permitted as a gravel operation or as a <br />construction yazd. <br />According to Mr. Starkebaum, the site has had a 10-acre permit since 1984 for the gravel <br />
