Walther
Executive Director
Ronald W. Cattany
Acting Division Director
Per your request, the Division is offering clarification as to the need of a permit modification if soil
amendments are added to the sand before trucking the material off site.
As long as the operator is not disposing or backfilling the mine operation with the sand & amendment
material, then he does not need to modify the pemut (that would make it off-site material and would
need to meet our "inert material" criteria). Also, as long as the operator is not amending the sand with
topsoil that was slated for reclamation (i.e. stripped from the mine area & stockpiled for reclamation).
If you have any questions, please do not hesitate to call me at 303-866-4943.
SincG~~~
Erica Crosby
Environmental Protectio pecialist
cc: Carl Mount; DMG (via electronic transmission)
