The required $217 fee has been
paid. This approval will cover the period April 1, 1999 through March 31, 2000.
Out of the 4.25 acres of maximum groundwater exposure that will occur during this plan,
2 acres were exposed prior to January 1, 1981. The maximum estimated depletions to be
covered total 9.08 acre-feet annually, consisting of 9.02 acre-feet of net evaporation off of 2.25
acres of post-1980 ground water exposure, and 0.06 acre-feet of water lost with mined product
(4% toss by product weight). A monthly breakdown of these amounts and their lagged affects
on the Arkansas River is given on the attached table. No pumping occurs for gravel washing,
dust suppression, or concrete botching purposes.
The source of replacement water to cover the plan's depletions is assumed to be the
same as was provided for the period April 1, 1998 through March 31, 1999. During that period
9.1 acre-feet of water was provided by LAWMA from its accounts in John Martin Reservoir, and
in return Bent County Ready Mix assigned to LAWMA the use of 12 shares of Fort Bent Ditch
Company stock. For this plan, Bent County Ready Mix must obtain an updated agreement
from LAWMA in which it again agrees to make the releases necessary to replace the depletions
identifed in this plan.
Bent County Ready Mix is willing to commit its 12 shares of Fort Bent Ditch stock to the
pit as a source of long term renewable supply of replacement water. These shares are
estimated to yield 11.0 acre-feet per year (0.92 aF/share) on average, and 6.0 acre-feet per year
(0.50 of/share delivered) in a dry year. Because the dry year yield is insuffcient to cover
evaporation loss, this proposed source is not sufficient to act as a long term renewable source
of replacement water. Prior to renewal of this plan a new or additional source of such water
must be provided.
The State and Division Engineers have reviewed the plan and the adequacy of each
source of water provided for use as augmentation water, including, where necessary, the
historical consumptive use of each water right, and return flows from diversion of waters
imported into the Arkansas River Basin or other fully consumable waters proposed for use as
