XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2), and 4.18 <br />Information pertaining to fish and wildlife is presented on pages 116-122 <br />of the permit application. <br />All wildlife species that have been found within the general area were <br />listed and their preferred habitats described. Due to the limited areal <br />extent of surface disturbance and pre-existing nature of this <br />disturbance, the Division has determined that impact to wildlife and <br />wildlife habitat will be minor. Also, Sunland is not proposing any <br />additional land disturbance. All disturbed runoff at the Apex No. 2 Mine <br />is routed through a sedimentation pond or otherwise controlled to <br />minimize deleterious effects of mining on the water quality of Trout <br />Creek. In addition, Sunland Mining has committed to three measures in <br />order to minimize impacts to wildlife resources: <br />1. Limiting activity during the sensitive deer and <br />elk wintering period; <br />2. Prohibiting the use of persistent pesticides; and <br />3. Prohibiting the discharge of firearms by employees. <br />No electric transmission lines exist or are proposed to be constructed <br />which pose a threat to raptors. <br />Pursuant to Rule 2.07.6(2)(n) and on the basis of available information, <br />the Division finds that the proposed activities will not affect the <br />continued existence of endangered or threatened species or result in the <br />destruction or adverse modification of their critical habitats. <br />The operation is in compliance with the requirements of this section. <br />XIV. Prime Farmland - Rules 2.04.12, 2.06.6 and 4.25 <br />Information pertaining to prime farmland is presented on page 123 of the <br />permit application. <br />Sunland has requested a negative determination as to the presence of <br />prime farmland at the Apex No. 2 Mine. The Division made such a negative <br />determination for the initial five-year permit and no information has <br />been submitted to change this determination. Therefore, the Division <br />reaffirms a negative determination on the existence of prime farmland at <br />this site. <br />The operation is in compliance with the requirements of this section. <br />XV. 0 erations Descri ti on - Rules 2.05.2, 2.05.3(1), <br />an <br />Information pertaining to the description of the operations plan is <br />presented on pages 124-181 of the permit application. <br />-16- <br />
