Box 1354 <br />Palisade, Colorado 81526 <br />Re: MLRD Inspections <br />Dear Mr. Fenwick: <br />I have read your letter of July 17, 1986 regarding MLRD access to Snowmass <br />Coal Company to conduct inspections. As you know, MLRD is required to conduct <br />unannounced inspections on an irregular basis at the mine site. Upon arrival <br />at the site the inspector is to identify himself and present appropriate <br />credentials to the company representative. In the event that a company <br />representative is not present, the inspector is to enter the site for the <br />purpose of carrying out his responsibilities. If an authorized representative <br />of the Division is refused admittance to the site or is refused access for the <br />purpose of conducting an inspection, the Division may institute civil action <br />as well as apply other appropriate measures to gain access to the site. <br />At times it is necessary for the Division to hold on-site meeting with <br />permittees and operators. When such meetings are necessary with Snowmass Coal <br />Company the Division will contact the appropriate representative in advafice <br />allowing for sufficient time to ensure a meeting can take place. If there is <br />a Snowmass Coal Company representative available within the vicinity of the <br />mine site, the Division would be happy to contact that individual on the day <br />of the scheduled unannounced inspection so that he may accompany the inspector <br />if he wishes. At the completion of an accompanied inspection, the inspector <br />will give an inspection report to the Snowmass Coal Company representative. <br />At the completion of an unaccompanied inspection, the inspector will send a <br />copy of the inspection report to the office designated in the permit. <br />With respect to theft or vandalism occurring at the Snowmass Coal Company <br />site, the Division will cooperate with any civil authority authorized to <br />investigate such matters. <br />If you have any questions regarding the Division's obligations or the <br />arrangements described above, feel free to call Mike Long or me. <br />Sinceerely, ~ <br />Fried R.
