Shelton <br />Director <br />In a telephone conversation with Elvin Clapp of the Kremmling BLM office, <br />it was determined that BLM has "no preference" in the matter of the regrading <br />of the Ranch Road at Mann Draw, provided: <br />1. The work is within the granted BLM right-of-way; <br />2. the work is of a minor nature; <br />3. the operator continues to live up to the agreements in .the BLM right-of <br />way grant (eg. maintains roads property). <br />BLM told Flatiron that they had "no problem" with the Ranch Road the way it <br />was. Mr. Clapp expressed to me that this did not preclude changes of the <br />type we asked Flatiron to do. He furthermore stated that Flatiron does not <br />need to send BLM a letter requesting an amendment to their right-of-way <br />grant. <br />It was also expressed that BLM consented to the elimination of culvert A <br />at the junction of the haul road and the county road. Flatiron was requested <br />to come in with a revision by November 30, 1980. Flatiron claimed to be <br />waiting for BLM's reply. I gave them until next inspection (unspecified <br />date) to get a revision into the office or they would be considered to be <br />in violation of their mine plan. <br />MLR requested on October 28, 1980 that Flatiron contact BLM with respect <br />to lowering the grade on the BLM Ranch Road contacting the haul road at Mann <br />Draw. MLR was concerned about ponding upstream from the Ranch Road which <br />could cause wash-out in a fair sized precipitation event. We asked Flatiron <br />to regrade the road down immediately in :the area of Mann Draw close to the <br />draw level. Flatiron later stated (12/IS/70 letter), "BLM does not approve <br />any changes in elevation for the Ranch Road". See above comments regarding <br />my converation with BLM Kremmling. I have given Flatiron until December 3I, <br />1980 to regrade this area and alleviate our concerns. <br />/k <br />
