_.. -E <br /> <br />2.03.5 <br />(3) A listing of each violation notice received by the applicant in con- <br />nection with any surface coal mining operation during the three year <br />period before the application date, for violations of any applicable law, <br />rule, or regulation of the United States, or of any Colorado law, rule, .or <br />regulation enacted pursuant to federal law, rule or regulation, or of any <br />provision of the Act pertaining to air or water environmental protection. <br />The application shall also contain a statement regarding each violation <br />notice, including: <br />(a) The date of issuance and identity of the issuing regulatory <br />authority, department or agency; <br />(b) A brief description of the particular violation alleged in the <br />notice ; <br />(c) The date, location and type of any administrative or judicial <br />proceedings initiated concerning the violation, including, but not <br />limited to, proceedings initiated by the applicant to obtain ad- <br />ministrative or judicial review of the violations; <br />(d) The current status of the proceedings and of the violation <br />notice; <br />(e) The actions, if any, taken by the applicant to abate the viola- <br />tion; and <br />(f) The final resolution of any notice of violation. <br />RESPONSE <br />1. On February 13, 1979, the Office of Surface Mining issued <br />violation No. 79V13. Two violations were issued under this <br />number. The first violation concerned an alleged non- <br />compliance with proper blasting procedures (Blasting signs <br />did not properly describe blasting procedures) . The second <br />violation alleged improper handling of topsoil as a result of <br />dozing topsoil along with brush. <br />Abatement: Violation No. 1 was abated on February <br />14, 1979. <br />Abatement: Violation No. 2 was abated on February <br />19, 1979. <br />A hearing was requested by H-G Coal Company and, as a <br />result of this hearing, Violations 1 and 2 were terminated on <br />March 26, 1979. <br />~ . + ti M <br />
