_.. -E 2.03.5 (3) A listing of each violation notice received by the applicant in con- nection with any surface coal mining operation during the three year period before the application date, for violations of any applicable law, rule, or regulation of the United States, or of any Colorado law, rule, .or regulation enacted pursuant to federal law, rule or regulation, or of any provision of the Act pertaining to air or water environmental protection. The application shall also contain a statement regarding each violation notice, including: (a) The date of issuance and identity of the issuing regulatory authority, department or agency; (b) A brief description of the particular violation alleged in the notice ; (c) The date, location and type of any administrative or judicial proceedings initiated concerning the violation, including, but not limited to, proceedings initiated by the applicant to obtain ad- ministrative or judicial review of the violations; (d) The current status of the proceedings and of the violation notice; (e) The actions, if any, taken by the applicant to abate the viola- tion; and (f) The final resolution of any notice of violation. RESPONSE 1. On February 13, 1979, the Office of Surface Mining issued violation No. 79V13. Two violations were issued under this number. The first violation concerned an alleged non- compliance with proper blasting procedures (Blasting signs did not properly describe blasting procedures) . The second violation alleged improper handling of topsoil as a result of dozing topsoil along with brush. Abatement: Violation No. 1 was abated on February 14, 1979. Abatement: Violation No. 2 was abated on February 19, 1979. A hearing was requested by H-G Coal Company and, as a result of this hearing, Violations 1 and 2 were terminated on March 26, 1979. ~ . + ti M
