<br /> <br />F q -- ~~ <br />- .~ _ o <br />.3 ,~ <br />Icy ; <br />MINE BLASTING VARIANCE AGREEMENT <br />1Li~i:G'C. ~aii.] <br />9000 <br />Cyprus Empire Corporation agrees to grant a variance from the 1,000 foot distance <br />requirement when blasting near inhabited buildings to permit Trapper Mining Inc. to blast <br />within approximately 600 feet of an inhabited building (see attached map) under the fol- <br />lowing terms and conditions: <br />1. Blasting will be done during daylight hours only; <br />2. Blasting within this 600-foot limit will be done no more often than three times per <br />week; <br />3. Cyprus Empire management and any persons located in the Mine Rescue building <br />will be notified as part of a pre-blast procedure and post-blast "all clear" proce- <br />dures; <br />4. A damage survey will be made of the Mine Rescue building prior to any blasting <br />under this variance and again following the last blast under this variance, both at <br />Trapper's expense; <br />5. Any damage occurring to Cyprus Empire's buildings, appurtenances or property as <br />a result of Trapper's blasting activities will be repaired at Trapper's expense; <br />6. Trapper will indemnify Cyprus for any expense related to personal injury of Cyprus <br />employees or contract personnel as a result of flying debris caused by Trapper's <br />blasting activity; <br />7.
