STIl'ULATION NO. 17 <br />SCC WILL SUBMIT 3 COPIES OF PAGE 16, TABLE 22-5, VOLUME X, TAB 22 FOR <br />FIELD MINOR REVISION #17 BY APRIL 18, 2002. <br />STATUS: Complied with 02/11/2003. Stipulation No. 17 has been satisfied by Ghe submittal <br />of the revised pages in a letter to the Division dated 04/12/2002. <br />SECTION IV -MIDTERM ADEQUACY QUESTIONS <br />The Division does not have any adequacy questions or continents regazding this Midterm <br />Review. <br />SECTION V -PERMIT VARIANCES AND SPECIFIC APPROVALS <br />During the current permit term, the Division granted a variance from contemporaneous <br />reclamation at the Yoast Mine. This variance applies to a portion of the current pit operations as <br />well as to portions of the mine site that have been backfilled and graded. A summary of the <br />vaziance approval is provided below. <br />Changes to the reclamation schedule for various areas at the Yoast Mine were approved with <br />Technical Revision No. 20. Pursuant to Rule 4.14.1(1)(c), the Division approved a vaziance <br />from the requirements that rough backfilling and grading be conducted within 180 days <br />following coal removal. This variance applied to the North Area pit and still applies to the <br />northern portion of the Yoast South Area pit, as depicted on Exhibit 19-1A. The North Area pit <br />has been backfilled and graded. The northern portion of the South Area pit has been mined out; <br />however, backfill and grading will commence during 2003/2004. In addition, channel <br />reconstruction will not commence in some mined out portions of the South Area pit unti12005. <br />SECTION VI -BONDING SUMMARY <br />The Division holds an approved bond on behalf of the permittee for the Yoast Mine. The bond <br />is a Corporate Surety from Seaboard Surety Company, Bond No. 329873, in the amount of <br />$4,600,000.00. Pursuant to Rule 3.02.2(4), the Division has reviewed the Yoast Mine <br />reclamation liability. <br />- - - - - Arttache~3s tfire~reclaznatiotrcost~stimate for the 2003 MidternrRevtew for the Yoast mine.- The <br />estimate is 66 Tasks (a summary sheet and tasks 001 - 087) and represents a new liability of <br />$4,455, 317.00. This is an increase of $36, 473.00 over SCC's current liability of $4,418,844.00. <br />The Division holds a bond of $4,600,000.00. SCC does not need to submit additional bond as a <br />result of this Midterm Review. <br />
