Schuett <br />Current Planner <br />Department of Planning Services <br />915 10th Street <br />Greeley, CO 80631 <br />Re: Varra Companies, Inc., Amendment No. 2, Permit No. M-74-052 <br />Dear Mr. Schuett: <br />The Division has received your letter requesting the Colorado Mined and <br />Reclamation Board to deny approval of the Amendment No. 2, Permit No. M-74-052 <br />until the applicant first obtained an amended Special Review permit rom the <br />county under Rule 34-32-115(4) of the Colorado Mined Land Reclamatio Act. <br />The Division has not received an amendment to the Dakolios Permit M- 4-036. <br />The Division is constrained from denying a permit by the following r les from <br />the Mineral Rules and Regulations (34-32-115): <br />(4) The Board shall grant a permit to any operator if the application <br />complies with the requirements of this article. The Board shall not eny a <br />permit, except for one or more of the following reasons: <br />(a) The application is incomplete or the performance and <br />financial warranties have not been provided. <br />(b) The applicant has not paid the required fee. <br />(c> Any part of the proposed mining operation, the recta ation <br />program, or the proposed future use is contrary to the laws or regula ions of <br />this state or the United States. <br />(d) The mining operation will adversely affect the stabi ity of <br />any significant, valuable, and permanent man-made structures located ithin <br />two hundred feet of the affected land, except where there is an agree ent <br />between the operator and the persons having an interest in the struct re that <br />damage to the structure is to be compensated for by the operator. <br />(e) Repealed, 1. 88 p. 1215, sec. 16, effective July 1, X988. <br />(f) The mining operation is located upon lands: <br />(I) Where mining operations are prohibited by law r <br />regulation within the boundaries of units of the national park system the <br />national wildlife refuge system, the national system of trails, the n tional <br />wilderness preservation system, the wild and scenic rivers system, or national <br />recreation areas; <br />
