Shelton, Director <br />Findings of the Colorado Mined Land Reclamation Division <br />for Transfer of Permit Rights of Maxwell Mine <br />Explanation of Findings <br />Pursuant to Rule 2.08.6(4) of the Regulations of the Colorado Mined Land <br />Reclamation Board, the Division must make three written findings prior to the <br />approval of a transfer of rights granted under any permit approval issued <br />pursuant to the Act. <br />These findings are made based on information made available to the Division <br />that the applicant will operate in compliance with the Colorado Surface Coal <br />Mining Reclamation Act and the Regulations promulgated pursuant to the Act. <br />1. The Division finds that the applicant will conduct the operations <br />covered by permit number C-013-81 in accordance with the requirements of <br />the Act and these Rules (Rule 2.08.6(4)(a)); <br />2. The applicant has submitted an acceptable reclamation bond in the amount <br />of (550,000.00 which is equivalent to the bond required of the original <br />permit applicant (Rule 2.08.6(4)(0)); <br />3. The applicant will continue to conduct the operations involved in full <br />compliance with the terms and conditions of permit number C-013-81 (Rule <br />2.08.6(4)(c)). <br />Doc. No. 8789 <br />
