The basis for your request is reasonable. Therefore the Division <br />will grant an extension of 60 days, until November 29, 1995. <br />We would like to advise P&M however, that the delay in developing the proposed ppostmining <br />topography should not interfere with the requirement to have completed rough bacldilling and <br />grading within 180 days of coal removal (Rule 4.141(1)(c)). In P&M's case, with the previously <br />approved winter grading variance (permit Section 3.4, page 3.4-1), rough backfilling and grading <br />must be complete by June 1, 1995.
