s <br />~,. <br />3. Your letter questioned which drainage design the proposed <br />addendum referred to. As discussed during our December 21, 1993 <br />meeting, the Division would instruct Mr. Kessler to construct a <br />drainage channel in accordance with the first design proposed by <br />Mr. Berry. The extent of riprap in the channel may be limited by <br />the availability of funds. Based on recent conversations with Mr. <br />Kessler, it does not appear that any major variances from riprap <br />application in the plan will be necessary. This would <br />approximately result in a channel configuration estimated to safely <br />pass runoff from a 10-year, 24-hour storm event in the watershed <br />above the pit (using the modelling assumptions from Mr. Berry's <br />revised hydrology modelling exercise). The field directive <br />referred to in the addendum will be formally submitted if and when <br />the agreement is appropriately revised. <br />4. Your letter questioned whether construction costs have been <br />increased because of limited access to the pit area. The Division <br />is discussing possible access to the pit from the Southfield Mine <br />yard area with Energy Fuels Inc. I do not know if additional costs <br />will be incurred at this time. If additional costs are incurred, <br />they will be accounted for in the Division's contract with Kessler <br />Reclamation. <br />Please review the enclosed addendum and let me know if you have <br />outstanding concerns. <br />Sincerely, <br />Larry P.
