DIVISION FOR REVIEW AND APPROVAL PRIOR TO EXPANSION OF THE <br />UNDERGROUND DEVELOPMENT WASTE PII.E. <br />Development waste from this mine was not produced in any quantities near 1000 yds'. Since the <br />portals have been sealed per MSHA specifications and no further mining is anticipated this <br />stipulation is no longer is effective. <br />STIPULATION N0.4 <br />THE O.C. MINE N0.2 WH.L CONTINUE TO PURSUE THE PERNIITTING OF THE <br />120 ACRE B.L.M. LEASE MODIFICATION AREA NORTH OF THE CURRENT <br />PERMIT AREA. THE OPERATOR SHALL SUBMTI' A COMPLETE PERNIIT <br />REVISION APPLICATION FOR THE 120 ACRE AREA NO LATER THAN JULY 20, <br />1992. . <br />The mine ceased mining operations in the later part of February 1992 because of poor roof <br />conditions. The operator attempted to find a buyer for the mine but none was found so the mine <br />was permanently closed. The operator submitted a permit revision to include the 120 acre lease <br />area, but this was found to be incomplete. Since nursing was discontinued the operator did not <br />pursue further permitting. "However, there is approximately 8.5 acres in the lease area that will <br />require an incidental boundary change; this revision will be a technical revision. The revision <br />should only include those areas that encompass the undermined area. Also, the most recent mine <br />plan map the Division has in its files, is eight years old. This should be revised with an up to date <br />map showing the final extent of the mine workings. As required by rule 2.10, maps shall be <br />prepared by or under the direction of, and certified by, a qualified registered professional engineer <br />or professional geologist. This revision will require a public notice with a legal description to be <br />published in the local newspaper. <br />Variances <br />The O.C. Mme No.2 permit does not involve any variances regarding mountain top removal or <br />the achievement of approximate original contour. There were no experimental practices allowed <br />at this site. There are no variances from the stream buffer zone requirements of Rule 4.05.18. <br />SECTION V -DECISION TO REQUIItE REVISIONS OR ADDTITONAL <br />INFORMATION <br />Monitoring <br />On October 22, 1992, the O.C. Mine was given a temporary suspension of water monitoring for <br />water discharging from the Nu Mme. The suspension was given for the period of temporary <br />cessation. However, since the mine is now in permanent cessation this suspension should either <br />be made permanent or monitoring must resume. Upon a comprehensive hydrologic review on the <br />monitoring program, the Division finds that water discharging from the Nu mine, at the present <br />O.C.
