~~ <br />MIDTERM REVIEW, O.C. Mine No. 2 <br />This document presents the results of the Division's Midterm Review of the O.C. Mme No. 2 <br />permit. This Midterm Review was conducted to fiilfdl the requirements of Rules 2.08.3, <br />2.06.2(10), 2.06.3(4), 2.06.7(5) and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued prior to its midterm <br />(2-1/2 years). On the basis of this review, for good cause shown, the Division may require <br />reasonable revisions or modiScation of the permit provisions to ensure.compliance with the Act <br />and Regulations. <br />Rules 2.06.2, 2.06.3.2.06.5 and 2.06.7 requue that experimental practices, mountain top removal <br />variances, variances from approximate original contour (AOC) and variances from <br />contemporaneous reclamation, respectively, be reviewed by the Division where applicable during <br />the midterm review. <br />a ,. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and the terms of <br />acceptance of the bond every 2-112 years. <br />This midterm review consisted of a detailed review of the O.C. Mme No.2 permit application and <br />Endings document to identify any items that may have been overlooked during the initial review. <br />The Division reviewed all subsequent revisions and stipulation responses to ensure that all permit <br />commitments and conditions were being followed. Hydrologic monitoring data were reviewed in <br />conjunction with the review of the application to assess the adequacy of the monitoring plan and <br />discussion of hydrologic impacts. Problems and observations from past inspection reports were <br />also considered. <br />SECTION I - HLSTORY <br />The O.C. Mme No. 2 is an underground mine undergoing permanent reclamation and is located <br />approximately 16 miles north of Gunnison Colorado. The permit area covers 80 acres and the <br />disturbed area is less than 4 acres. When active, this mine produced approximately 7,000 to <br />10,000 tons of coal per year from Federal Coal Lease No. CO-069942. The Mine was closed <br />because of poor roof conditions that made mining unproStable. <br />The original pennit was issued October 25, 1979, to Opal and Henry Weaver who operated the <br />mine since 1968. Macar I~fming Corporation operated the mine from October 1978 until July 15, <br />1981, when the permit and operations were returned to Opal and Henry Weaver. They operated <br />the mine until April 10, 1991 when the permit was transferred to Elizabeth and Robert Weaver. <br />The last renewal was granted May 15, 1992. This mid-term review covers the past two and one <br />half years. <br />Enforcement Action <br />No enforcement actions have been issued to this mine since the permit renewal. <br />O.C.
