The applicant shall develop, operate, and manage the mining-related activity according to the <br />rules, regulations, plans and permits administered by the applicable Federal, State, and local - <br />agerrcies. Any violation of a rule, regulation, permit, or plan may result in the scheduling of a <br />Show/C'ause Iiearing to consider the revocation of Special Use Permit No. 1998-041. <br />6. 7'he Department of Planning and Development is directed to conduct an administrative <br />inspection of the property on or before January 1, 2000. Ifthe use authorized by this Special <br />LJse Permit has been established, and if the property is found to be in compliance with the <br />Pueblo County Zoning_Resolution and all other requirements outlined in this report, the <br />perrnit will be placed on a complaint basis only. If the property is NOT in compliance, the <br />permit shall be scheduled for the January, 2000, Pueblo County Planing Commission meeting <br />for none-year review. <br />7'he applicant shall apply for new access permits for their proposed access points. All <br />conditions associated with said permits shall be complied with and construction completed <br />prior to conunencing operation of the pit. An approved access permit(s) shall be deemed as <br />compliance with this condition. <br />7'he applicant shall work with the Pueblo County Public Works Department to establish a haul <br />route from the Cesar Pit that is acceptable to both the applicant and the Pueblo County Public <br />Works Department. <br />9. Prior to commencing the gravel operation the applicant shall place a hash mark at the side of <br />the haul route a.t tenth (0.10) of a nrile intervals starting at the applicant's point of access to <br />St. (:harles Road. Each mark shall bear the appropriate tenth (0.10) of a mile reading <br />beginning at the applicant's access point (e.g. 0.1 at the first mark, 0.2 at the second, and so <br />on). The applicant shall then video tape the haul route, at the applicant's expense. The <br />videotape shall be produced in standazd VHS format in such a way and at such a speed that <br />any defects in the roadway surface shall be easily discernible for viewers. This will be the <br />established baseline for repair requirements. Upon completion of all mining related activities <br />under this SUP or every six (6) months (during miming activity only), whichever is less, the <br />applicant shall repeat this process. A copy of this videolog will be submitted to Public Works <br />prior to commencing operation of this pit. The time frame between video taping can be <br />extended at the discretion of the Pueblo County Public Works Director. <br />10. T'he applicant shall be responsible for repairing any damage to the haul route that occurs <br />during the applicant's hauling period. The applicant shall repair in good workmanlike manner <br />any darnage to said roads caused by trucks hauling from the site as determined by the Pueblo <br />County Public Works Department. <br />Repairs shall include, but not be limited to, fixing potholes and restoring the road to a <br />condition as good as or better than existed prior to commencement of the applicant's <br />operations under the Special Use Permit. The videolog will be used by Public Works to <br />determine the extent of repairs required. <br />
