You had requested guidance from the Water <br />Quality Control Division (WQCD) on acceptable reclamation criteria for the above.referencedsfte, <br />under a stormwater discharge permit. <br />The criteria as outlined in your letter will be acceptable for allowing termination of discharge permit <br />coverage, once the vegetation has become established. I have attached a copy of the.text from the <br />stormwater Metal Mining pemrit (which also covers coal mints) that is relevant to this situation. <br />Also note that the basic underlying tenet for coverage of mines is that a stormwater permit is <br />required only if runoff contacts ovezburden, raw material, intermediate or finished products, or waste <br />products, and is then discharged to state waters. It sounds as if completion of the process described <br />in your letter will eliminate the need for a permit. <br />It is important to be very clear about what sites will be covered under the Division of Minerals and <br />Geology's stormwater pernrit, and what sites will remain undez Mid-Continent's industrial discharge <br />permit. This should be specified in the permit application, as well in as the Stormwatez Management <br />Plan (SWMP). I have enclosed a copy of the application fot your use, as well as a copy of the , <br />guidance document for preparing a S WMP. <br />Exhibit E to Settlement Agreement . . <br />
