Long <br />Division Dueclor <br />We have received a copy of the above mentioned report, which constitutes continued <br />compliance with Stipulation No. 31 to the Edna Mine permit. We have the following <br />comments regarding the project. <br />1. The report states that 19 check dams were complete as of October 13, 1993. Of those <br />nineteen, 11 were completed during the 1992 construction season. The construction <br />schedule outlined in Appendix 4.6-M of the approved Edna Mine permit estimated that <br />all 23 of the check dams would be complete by the end of two four month construction <br />seasons, an average of three dams per working month. While P&M is not out of <br />compliance with their commitment to complete construction of the entire project by <br />October 31, 1995, it should be noted that the anticipated progress has not been met. <br />2. Appendix 4.6-M includes an inspection schedule for the dams, which states that the <br />dams will be inspected "at least once annually for erosional features and evidence of <br />instability. A written report of the findings from the field inspections will be forwarded <br />to the CMLRD during the third quarter of each year." We have not yet received a copy <br />of this report. Please advise the Division of the status of this report. <br />3. The check dams, as designed, are considered temporary impoundments and therefore <br />must be in compliance with Rule 4.05.9(2) of the Rules and Regulations of the Colorado <br />Mined Land Reclamation Board. That rule states that impoundments shall be in <br />compliance with a number of other rules, one of which is Rule 4.05.6(10). Rule <br />4.05.6(10) requires that the construction of each check dam be certified by a qualified <br />registered professional engineer, and that a copy of that certification be forwarded to <br />
