<br />Proposed becision <br /> <br />The Colorado Mined Land Reclamation Division proposes to approve with <br />stipulations an application for renewal of a valid existing permit. <br />The application was submitted by Wyoming Fuel Company for the Golden Eagle <br />Mine. This decision is based on a finding that the operations will comply <br />with all requirements of the Colorado State Program as found in the Colorado <br />Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the <br />Regulations promulgated pursuant to the Act. If no reque~for a formal <br />hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. Upon <br />submittal of acceptable surety by the applicant, the permit will be issued. <br />The permit application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />Stipulation No. 8 <br />PRIOR TO SECONDARY OR RETREAT MINING AT THE GOLDEN EAGLE MINE, THE <br />PERMITTEE SHALL PROVIDE A HYDROLOGIC SURVEY IDENTIFYING ALL ALLW IAL <br />AQUIFERS IN, OR ADJACENT TO THE PERMIT AREA (EXCEPT FOR THE PURGATOIRE <br />RIVER ALLW IAL AQUIFER WHICH HAS ALREADY BEEN IDENTIFIED). THIS SURVEY <br />SHALL CONTAIN INFORMATION CONCERNING DEPTH BEL04! THE SURFACE, HORIZONTAL <br />EXTENT, WATER USE, AND QUANTITY AND QUALITY OF GROUND WATER AS REQUIRED <br />UNDER RULE 2.04.7(1). THE PERMITTEE SHALL ALSO PROVIDE A DISCUSSION OF <br />THE PROBABLE HYDROLOGIC CONSEQUENCES OF MINING UPON THOSE ALLW IAL <br />AQUIFERS IDENTIFIED. <br />Stipulation 12: <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER CIRUELA CANYON, APACHE CANYON, <br />AND SANTISTEVAN CANYON DRAINAGES, THE PERMITTEE MUST COLLECT DATA ON THE <br />QUANTITY OF WATER FLOWING IN THESE DRAINAGES. MONITORING MUST BE <br />SUFFICIENT TO DIFFERENTIATE SEASONAL FLOW VARIATIONS. <br />THE PERMITTEE MUST MONITOR THE QUALITY OF WATER FLOWING IN CIRUELA CANYON <br />QUARTERLY. MONITORING MUST BE DONE AT TWO SITES, ONE ABOVE THE MINE <br />WATER DISCHARGE POINT AND ONE BELOW TO COAL PROCESSING WASTE PILE. <br />THE PERMITTEE SHALL PROVIDE AN AMENDMENT OF THE PROBABLE HYDROLOGIC <br />CONSEQUENCES OF SECONDARY OR RETREAT MINING ON THE QUANTITY AND QUALITY <br />OF SURFACE WATER IN CIRUELA, APACHE, AND SANTISTEVAN CANYONS. <br />ALL MONITORING MUST CONTINUE UNTIL DISCONTINUATION IS APPROVED BY THE <br />DIVISION IN WRITING. <br />Stipulation No. 14 <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER APACHE CANYON OR SANTISTEVAN <br />CANYON, THE PERMITTEE MUST SUBMIT TO THE DIVISION SUFFICIENT EVIDENCE FOR <br />THE D N ISION TO MAKE FINDINGS THAT SECONDARY OR RETREAT MINING UNDER <br />THESE CANYONS NIL L: <br />-2- <br />
