Canany <br />Division Director <br />NaNral Resource Trustee <br />Re: Foide] Creek Mine, Permit C-1982-056, Coal Complete Inspection of May 3, <br />2005, Determination of Impoundment <br />Dear Mr. Nettleton: <br />The Colorado Division of Minerals and Geology (Division) has completed a review of <br />the classification of the cuttings pit at the 18-Right Ventilation Shafr site. As we <br />discussed briefly by telephone yesterday, the Division concludes that the pit is, under <br />Rule 4.05.9, an impoundment. As such, please add this structure to your list of <br />impoundments (for inspections, etc.). In addition, please submit the engineering designs <br />as appropriate to this impoundment within 30 days. <br />We also discussed, during our telephone conversation, the pending closure of the cuttings <br />pit. The Bleeder Shafr Pad SAE, Rock Filter and Grass Filter below Pad, of Exhibit 8T, is <br />the current sediment control demonstration for the 18-Right Ventilation Shafr pad. Please <br />revise this demonstration in the event that the closure results in any condition (watershed <br />area) that would increase the potential for sediment-laden runoff to leave the disturbed <br />area. <br />In addition, please include (see page 2.05-106), and make reference to, a large-scale <br />design of the f nal reclamation (proposed reclaimed contours) of the 18-Right Ventilation <br />Shafr site. <br />Please call me if you have any questions. <br />Yours truly, <br />Byron G.
