<br />PROPOSED DECISION <br />In accardance with Rule 3.03 of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining, this document constitutes written notification of the Division's decision to approve a <br />Phase II bond release at the Golden Eagle Mine (permit number C-81-013) permitted and operated <br />by Bn Resources, Inc. (BRI). Lands included in this bond release are labeled A-R and depicted <br />on Fi re A-l of the bond release application. Specific areas excluded from this release include the <br />NW-l. ventilation shaft and access road, the upper Apache Canyon ventilation site and the lower <br />Apache Canyon ventilation site. The rationale for this approval are as outlined below. <br />BACKGROUND <br />The Golden Eagle Mine is a reclaimed, underground mine that is permitted and operated by Basin <br />Resources, Inc. The mine is located in Las Animas County, approximately 4 miles west of the town <br />of Weston, in portions of sections LS-22 and sections 27-34, T33S, R67W. The mine ceased coal <br />production on December 3l, 1995. Structure demolition and site reclamation was conducted during <br />1996 and early 1997. Approximately 59 acres were disturbed and reclaimed at this site. <br />Golden Eagle mine during operations - 1995 <br />This bond release request (SL-03) requests a Phase II bond release for the main body of reclamation <br />as shown on Figure A-l of the application on lands located in section 29, T33S, R67W. The <br />cumulative total acreage of areas labeled A through R on Figure A-1 equals S 1.26 acres. <br />Specifjcally excluded from this Phase II request aze three small reclaimed areas; the NW-1 <br />ventilation shafr and road, the Lower Apache Canyon ventilation shaft, and the Upper Apache <br />
