United States Department of the Interior <br />OFFICE OF SURFACE MINING <br />Reclamadoa and Enforcement <br />WASHINGTON, D.C. 20240 <br />JUN 2 iSS3 <br />Ia~~ <br />rmoEw~ <br />~ ^ <br />Memorandum <br />To: Asai n 9 ar --Land and Minerals Management <br />From: D <br />Subject: Recommendation to Approve the Bear No. 3 Mine <br />Mining Plan Modification, Bear Coal Company, <br />Inc., Gunnison County, Colorado, Federal Leases <br />D-052501 and C-42481 <br />I recommend approval of the Bear No. 3 mine mining plan <br />modification for Federal leases D-052501 and C-42481 <br />subject to the Mineral Leasing Act of 1920, as amended. <br />My recommendation to approve the Bear No. 3 mine mining <br />plan modification is based on: (1) Bear Coal Company, <br />Inc.'e complete permit application package (PAP), as <br />updated through April 13, 1989, (2) review of the PAP by <br />the Colorado Mined Land Reclamation Division as required <br />by the Colorado State program and cooperative agreement, <br />(3) the Federal lands review pursuant to section 522(b) of <br />the Surface Mining Control and Reclamation Act of 1977, <br />(4) comments and recommendations or concurrence of other <br />Federal agencies, including the findings and <br />recommendations of the Bureau of Land Management with <br />respect to the resource recovery and protection plan and <br />other requirements of the Federal lesaea and the Mineral <br />Leasing Act of 1920, as amended, (5) compliance with the <br />National Environmental Policy Act of 1969, and (6) <br />documentation assuring compliance with applicable <br />requirements of other Federal laws, Bxecutive Orders, and <br />regulations. <br />The Secretary may approve a mining plan under 30 U.S.C. <br />207(c) and 1273(c). I find that the proposed mining plan <br />will be in compliance with all applicable laws and <br />regulations. Pursuant to 30 CFR Part 746, I have attached <br />the decision document for the proposed mining plan action. <br />The currently approved mining plan for Federal lesaea <br />D-052501 and C-42481, along with this proposed mining plan <br />action, is reflected in the proposed mining plan approval <br />document included in the decision document. <br />
