United States Department of the Interior OFFICE OF SURFACE MINING Reclamadoa and Enforcement WASHINGTON, D.C. 20240 JUN 2 iSS3 Ia~~ rmoEw~ ~ ^ Memorandum To: Asai n 9 ar --Land and Minerals Management From: D Subject: Recommendation to Approve the Bear No. 3 Mine Mining Plan Modification, Bear Coal Company, Inc., Gunnison County, Colorado, Federal Leases D-052501 and C-42481 I recommend approval of the Bear No. 3 mine mining plan modification for Federal leases D-052501 and C-42481 subject to the Mineral Leasing Act of 1920, as amended. My recommendation to approve the Bear No. 3 mine mining plan modification is based on: (1) Bear Coal Company, Inc.'e complete permit application package (PAP), as updated through April 13, 1989, (2) review of the PAP by the Colorado Mined Land Reclamation Division as required by the Colorado State program and cooperative agreement, (3) the Federal lands review pursuant to section 522(b) of the Surface Mining Control and Reclamation Act of 1977, (4) comments and recommendations or concurrence of other Federal agencies, including the findings and recommendations of the Bureau of Land Management with respect to the resource recovery and protection plan and other requirements of the Federal lesaea and the Mineral Leasing Act of 1920, as amended, (5) compliance with the National Environmental Policy Act of 1969, and (6) documentation assuring compliance with applicable requirements of other Federal laws, Bxecutive Orders, and regulations. The Secretary may approve a mining plan under 30 U.S.C. 207(c) and 1273(c). I find that the proposed mining plan will be in compliance with all applicable laws and regulations. Pursuant to 30 CFR Part 746, I have attached the decision document for the proposed mining plan action. The currently approved mining plan for Federal lesaea D-052501 and C-42481, along with this proposed mining plan action, is reflected in the proposed mining plan approval document included in the decision document.
