To bring this issue to closure, <br />I am suggesting that the States estimate was to high and that <br />the contractor's estimate was to low. I am contending that <br />from what the photos only, the amount of lost topsoil loss <br />might be about 800 cu yds or approximately 1/4 of what was <br />previous estimated by the State. It should be noted that is <br />does appear that quantities of "B" Horizon material were lost <br />over the edge of the high wall. It is also noted that the <br />contractor was required to save the first foot of topsoil and <br />next two feet of "B" Horizon and that anything beyond that was <br />not included in the contract. <br />#4 <br />The State has a claim aga inst the contractor for six days of <br />time due to the work goin g that amount of time over schedule. <br />The amount bein g claimed is S1.800. <br />The contractor has not been able to substantiate any cause as <br />to why the State might have delayed this project resulting in <br />an extension of the six days for which the State is now <br />claiming liquidated damages. <br />
