INTO EXHIBIT 30. THIS REVISION SHALL INCLUDE A CERTIFIED STATEMENT FROM A <br />REGISTERED PROFESSIONAL ENGINEER WHICH VERIFIES THAT ACTUAL PREP <br />PLANT REFUSE FROM LORENCITO COAL IS, FOR STABILITY PURPOSES, <br />REPRESENTED ACCURATELY BY THE SAMPLE COAL WASTE USED IN THE ANAYS/S <br />DATED May 19, 1997 AND CERTIFIED BY MARK GRAY, P.E. OF CTL THOMPSON, INC. <br />Since the last midterm review in August 2001, the Lorencito Canyon mine (#C-96-084) ceased <br />operations and accepted a renewed permit for reclamation only. The railroad tracks leading to <br />the New Elk mine have been salvaged and the batch weigh loadout system has been <br />removed. Since coal is no longer shipped to the New Elk site and coal will not be processed, <br />there is no longer a need for a stipulation requiring testing of the actual coal waste properties, <br />especially for Lorencito-produced coal. Therefore, this stipulation is terminated as a result of <br />Permit Renewal No. 4. <br />PROOF OF RESOLUTION AND/OR SETTLEMENT SHOULD BE SUBMITTED TO THE <br />COLORADO DIVISION OF MINERALS & GEOLOGYAS SOON AS AVAILABLE FOR THE <br />FOLLOWING VIOLATIONS OR FEDERAL CITATIONS: C98-081-414-001, KENTUCKY <br />PERMIT #4977004; 050265, 050320, 052522, KENTUCKY PERMIT #890140. <br />As a result of information provided by the Applicant Violator System prior to permit issuance <br />for Permit Renewal No. 3, Stipulation No. 12 was attached to the permit. During RN-04, the <br />check of the Applicant Violator System indicates that these Federal citations or violations are <br />no longer linked to the New Elk mine (#C-81-012). Therefore, stipulation #12 is terminated as <br />a result of Permit Renewal No. 4. <br />APPROVAL OF MINOR REVISION NO. 83 FOR THE NEW ELK MINE IS CONDITIONED <br />UPON THE RESOLUTION OF THE FOLLOWING: <br />1)KENTUCKY CITATION NO. C-98-081-414-001 (KY 4977004), ASSOCIATED WITH STAR <br />FIRE MINING COMPANY,• <br />2)KENTUCKY FORFEITURE, CESSATION ORDERS NOS. 050265 AND 050320 AND <br />CIVIAL PENALTIES NOS. 052522, 052908 AND 053099 FOR PERMIT NO. 8980140, <br />ASSOCIATED WITH CATAWABA INDUSTRIES; <br />PROOF OF RESOLUTION SHOULD BE SUBMITTED TO THE COLORADO DIVISION OF <br />MINERALS AND GEOLOGYAS SOON AS IT BECOMES AVAILABLE. <br />Similar to Stipulation #12, the check of the Applicant Violator System conducted during this <br />permit renewal indicates that these Federal citations or cessation orders are no longer linked <br />to the New Elk mine (#C-81-012). Therefore, Stipulation #13 is terminated as a result of <br />Permit Renewal No. 4. <br />There are no active stipulations at the time of Permit Renewal #4. <br />
