NESLIN <br />DIR EGT LINE; 13031 963-3301 <br />March 15, 1993 <br />VIA FACSII~lILE <br />Frank R, Johnson, Esquire <br />Attorney General's office <br />Natural Resources Section <br />1525 Sherman street, Third Floor <br />Denver, Colorado 80203 <br />Re: Agreement Terminating Harrison <br />Wester 's_Responaibilitiea <br />Dear Frank: <br />We have preliminarily reviewed with our clients <br />the draft agreement that you sent us last week. <br />Rased upon Chia review, it appears that Harrison <br />Western sad the Division are close to a final agreement. <br />we would, however, ask that the Division consider incor- <br />porating the following revisions to your draft: <br />Introduction: The reference to January 1993 should be <br />changed to March 1993. <br />Paragra8h 3: Thin paragraph seems unnecessary in view <br />of paragraph number 4 and is somewhat misleading in that <br />Harrison Western has not experienced difficulty in sat- <br />isfying many of the terms of the compliance agreement. <br />Under these circumstances, we respectfully suggest that <br />paragraph 3 be deleted. <br />Paragraph e: This paragraph leaves blank the time <br />period for the Division to return Harrison Western's <br />bond and omits the requirement that the Division cancel <br />all pending notices of violation and cessation orders. <br />Harrison Western respectfully requests that this para- <br />graph incorporate the same time frame for returning the <br />performance bond as is set forth in paragraph 7 for <br />*~ TOTRL FAGE.003 *~ <br />
