The rest of your statements concerning that visit are incorrect. <br />The contractor vas vorkittg on part of the Eaet Pit in the wrong eequencn <br />according to the Contract, and he vas puehiug topsoil into the Pit <br />without saving 'it ae required by the Contract. when I told Mr. Nelson <br />of these concerns he wflE uncaucerned and did not have an eppropri.Rte <br />response. As a matter of fact, I have complained ei.nce to the Divlaioa <br />with no response.. Topsoil. is still being lost, parcicularl.y now being <br />mixed with boulders and too much rock substrata. <br />Next, 1 informed Mr. Nelson that the dozers did not have the rrqui.red <br />safety equipment such as beekup alarms. His reply was that "the <br />operators have ~uat gotten tired of listening. to them and have turned <br />them off". At my urging, Mr. Nelson stopped .ono dozer on]y to learn <br />that the alarm vas not in operating conditl.nn. I stopped tba second <br />dozer that dial not have an alarm. At this point Hr. Nelson's only <br />comments were vulgarities. Letcr, I asked Mr, Nelson if he wished to <br />inspect the. dozers. He said "you do i.t". That vas the only time that I <br />climbed on a machine. Si,ou].d. I not do what Hr. Nelson said for me L'o <br />do? The dozer operator said that he vas not wearing bin aeatbelt. <br />Interference, dangerous) Nw can insistence for aefety he defined that <br />way? 7 am willing to assume liability for my safety. Please note that <br />I was the only individual on the lice in compliance with OSHA <br />requirement for a hard ha c. kfien you take your legal steps, it will <br />make interesting testimony.Chat your representatives are not interested <br />in safety rules 'and that "efficiency and timclyness" ate more important <br />than safety. <br />Since my previous efforts to request the best saving of the topsoi]. have <br />f.ai].cd, I am making this a formal complnint that the Division`s own <br />regulations for the saving of topsoil are not being met.
