December 1, 1992 (the "Plan"), and in support of their motion <br />represent as follows: <br />1. The Court's order confirming the Plan (the <br />"Confirmation Order") was entered on February 12, 1993. <br />2. As part of the Confirmation Order (at page 15, <br />paragraph 12a of the Order), and based upon the "Notice of <br />pebtors' Selection of Three Trustees for Voluntary Employee:>' <br />Beneficiary Association to be Established IInder Debtors` and <br />Railroad Trustee's First Amended and Restated Joint Plan of <br />Reorganization Dated December 1, 1992," (Docket No. 2310) tYie <br />Court appointed (as initial trustees of the VEBA selected by the <br />Debtors) Robert W. Mac Cannon, Joan F. Vialpando, and Art;YUr' L. <br />Schwager as three of the six initial trustees of the VEBA. <br />3. After entry of the Confirmation Order, Mr. Schwager <br />advised the Debtors that he could not serve as a trustee of the <br />VEBA. <br />4. Debtors have selected Mr. Chelsie R. Pearson as Mr•. <br />Schwager's replacement. <br />5. Mr. Pearson, 1208 W. Abriendo Avenue, Pueblo, Colorado <br />81005, telephone-719-542-7439, was born September 13, 191't. He <br />holds a degree in Chemical Engineering from the IIniversit}~ of <br />Colorado. ?Sr. Pearson was hired by CF&I on September 30, 1939, <br />and retired on January 31, 1983 as the Works manager with 44 . <br />years of service.
