2 <br />complete and BLM accepted reclamation bond with the State, at which time <br />reclamation work would not be immediately required. M&M II, as the operator <br />of record, must either put the Joker Mill into regular substantial operations <br />or reclaim the site to BLM standards. <br />Since there seems to be no immediate or long-term plans to put the Joker Mi11 <br />into production, and due to the prolonged period of inactivity related to the <br />Joker Mi11, we must once again require that M&M II begin doing the reclamation <br />work as required in the surface management regulations Found at 43 CFR 3809. <br />Refer to our previous correspondence citing specific regulations that govern <br />mining activities on public lands. M&M II is hereby required to submit a <br />reclamation plan detailing the timeframes and activities related to reclaiming <br />the Joker Mine site within thirty (30) days of receipt of this correspondence. <br />M&M II is to begin this reclamation work within sixty (60) days of receiving <br />this correspondence. M&M II, being the operator of record, is the only BLM <br />recognized operator who is permitted to operate the Joker Mill and who is <br />responsible For all compliance items including but not limited to completion <br />of all required reclamation work done to BLM standards. At this time, only <br />M&M II may conduct mining activity that's in the approved plan of operations <br />and reclamation work. Any other mining related activity conducted by either <br />M&M IT or any other third party is not authorized. <br />Failure to comply with the requirements set Forth in this correspondence may <br />result in the issuance of 93 CFR 3809 and 93 CFR 3715 Notices of Non- <br />compliance (NON) (see ,§3809.602, X3809.603, X3809.604, X3809.700, X3715.7-1, <br />X3715.7-2, and §3715.8 for specific enforcement actions and penalty <br />descriptions). Be advised that continuing to operate with outstanding NON's <br />may impact the operations on any and/or all other projects that Mining and <br />Minerals II, Ltd. and it's officers have on public lands, including those on <br />other mining claims leased to other operators. <br />Compliance inspections will be scheduled periodically after receipt of this <br />notification to insure that the reclamation work has been instigated as <br />required and that it meets with BLM standards. <br />Also, be advised that failure to comply with the requirements as presented <br />here may result in the BLM, in concert with the CDMG, moving to procure the <br />funds necessary to complete the reclamation work as required using Mining and <br />Minerals II, Ltd.'s existing reclamation bond. <br />Should you have any questions or concerns in the future, please feel free to <br />contact Robert Ernst at (970) 826-5079. <br />Sincerely, <br />cJ~~ <br />~~ John E.
