Dept. of Na[ural RBSOIrF'CL'S <br />From: Chairman, Sale Panel for Coal Leasing <br />Subject: Post-Sale Evaluation Competitive Coal Lease Sale C-34586 <br />At the subject coal lease sale held on .tune 14, 1953, Ferma :•fining Corporation <br />was the high and only bidder. The bid submitted was in the amount of $617.25 <br />per acre for a total of $55,555.20. This bid exceeded the floor of $465 per <br />acre established for this sale. <br />It has been determined by a member of the Sale Panel that the application <br />submitted by Chimney Rock Coal Company meets the criterion for maintaining an <br />existing coal operation. Pursuant to 43 CFR 3425, Perma :•(ining Corporation is <br />eligible for lease considerations. <br />Based on the consensus of the Sale Panel, I recommend rite required documents, <br />as submitted by Perma Mining Corporation, be referred immediately to the <br />Attorney General, Antitrust Division, Department of Justice for review for <br />compliance with the antitrust provisions of P.L. 94-37?. <br />I further recommend that if the Attorney General determines that Perma *lining <br />Corporation is in compliance with the antitrust provisions of P,L. 94-377, you <br />or your delegate issue a coal lease to Perma t•fining Corporation. <br />;r ~ <br />. ;• <br />1 <br />
