It appears that there is <br />a misunderstanding concerning the discharge from the gravel washing area. <br />In your letter you explain that you thought the discharge was under a <br />grandfather clause and exempted from the permit. Thie is not the case <br />under the laws which regulate sand and gravel operations. Each point <br />source discharge associated with your operation, regardless of age, must <br />be covered under your permit. If not authorized under the permit, then <br />the point source needs to be eliminated. Any unauthorized discharge is <br />a violation of both state and federal law. <br />A review of your original permit application shows that the only <br />discharge applied for was "pit dewatering". Ae a result, the permit was <br />issued solely for the pit dewatering activity. <br />Enclosed is an applicaiton form which needs to be completed if you wish <br />to use the gravel washing discharge point. To legally do so will <br />require a permit amendment. If you elect some alternative to <br />discharging this water to the ditch, please describe.
