BANTA, Director <br />DATE: April 14, 1989 <br />T0: Tom Gillis _~ <br />FROM: Jim Pendleton <br />RE: Reclamati n of th lght Coal Mine Surface Facilities <br />I decided to volunteer a few suggestions for your consideration, following our <br />visit to the site. As you are all too aware, the E13,000.00 bond revoked from <br />Sunlight Coal is woefully inadequate to accomplish the task at hand. I <br />suggest you proceed as follows. <br />(1) Complete your evaluation of the conditions existing at the property, <br />inventorying the reclamation tasks you perceive to exist. <br />(2,), EstabTi.sh clear priorities for site reclamation activity, such as <br />"el;iminating hearth and safety hazards", "demolition of structures", <br />"regrading of site",-etc. <br />(3) Seek legal opinion from attorney general's representatives concerning the <br />extent of liability of the operator beyond bond forfeiture, the legal <br />ownership of equipment and structures existing on the property (could <br />salvage val"ue be copfi-scated and applied to actual reclamation costs over <br />a"nd abgve the boed forfeiture?), etc. <br />(4) Prepare and solicit separable bids for the various reclamation tasks. <br />(5) Accomplish the reclamation tasks in the order of your assigned priorities. <br />I must admit my surprise at tie Stout steel construction of the existing <br />tipple structure at the SI~nlig~it Mine. I doubt that it would be cost <br />effgctiye to attempt to remove tie structure. I believe iY is~'structura]ly <br />coptpe,tent"enough to syr•viye`indefinitely.
