Following are Minrec's responses to the DMG's concerns: <br />With regard to repair of bridges, both bridges are closed to vehicular traffic (behind locked <br />gates). Therefore, the bridges should not have to support light vehicles. Minrec would <br />prefer to dismantle the bridges instead of bringing them up the DMG's standards. The <br />bridge to the portal area was utilized in 1988 to excavate the portals to control mine <br />seepage. It was utilized again in 1998 to backfill the portals. Further maintenance in the <br />portal area may be performed with ATVs. The bridge along the fan access road has not <br />been utilized for may years. It is suitable for foot and ATV travel. <br />Three rules were quoted regarding handling pond cleanings, Rules 2.05.3(4)(a)(ii)(C), <br />2.07.7(2) and 4.11.4. Rule 2.07.7(2) states: "The permitee shall dispose of solids, sludge <br />filter backwash, or pollutants removed in the course of treatment or control of waters or <br />emissions to the air in the manner required by Rule 4 and which prevents violation of any <br />other applicable State or Federal laud'. Rule 4.11.4 allows for the disposal of noncoal <br />wastes in the permit area. Would it be possible to permit a disposal area along and above <br />the long pond? The cleanings could be buried, covered with soil and the disturbed area <br />vegetated. The environmental effect would be the same as if the cleanings remained in <br />the pond. <br />Your comment regarding the road that crosses the field to the Roaring Fork River is noted. <br />I will work towards obtaining a letter from the landowner. <br />I will initiate the installation of perimeter markers in July. Would you please confirm that <br />access/light use roads need to be marked. My experience is access/light use roads are <br />typically not delineated with perimeter markers. <br />
