Box 15596 <br />Lakewood, Colorado 80215 <br />RE: New Elk Mine, C-012-81, Thickener Overflow <br />Dear Mr. Stout: <br />The Division is aware that some overflow from the thickener plant is occurring <br />on a regular basis. We understand this is a temporary situation resulting <br />from inbalances in your preparation system and that installation of a fine <br />coal processing circuit should rectify the situation and create the desired <br />closed circuit system. <br />The overflow is now being routed to pond 006, which we feel is the most <br />prudent treatment at this stage. You must coordinate with the Colorado <br />Department of Health if release of water from this pond becomes necessary. <br />Also, close communication with this Division should be maintained to inform us <br />of any unforeseen problems that arrive while fine-tuning of the preparation <br />facility is on-going. <br />If you have any questions, please call. <br />Sincerely, <br />Candace M.
