Pursuant to Rule 2.07.6(2)(n) and on the basis of available information, the
Division finds that the operation will not affect the continued existence of
endangered or threatened species or result in the destruction or adverse
modification of their critical habitats.
The Division finds the operation in compliance with the requirements of this
section.
XIV. Prime Farmland - Rules 2.04.12, 1.06.6 and 4.25
Section 2.04.12 of Volume I and Exhibit 14 of Volume II of the application
contain information pertinent to Prime Farmlands.
The applicant has supplied documentation from the Sail Conservation Service
(USDA) stating that there are no prime farmlands in the vicinity of the mine.
Although a soil series (Tobin Silty Clay Loam) was pre v5ously identified as
prime farmland, the short growing season of the region and poor capability
class rating of the soil excludes it from this classification.
Pursuant to 2.07.6(2)(k) and on the basis of documentation provided by the
applicant, the Division has determined that no prime farmlands exist within
the permit area.
XV. Operations Description - Rules 2.05.2, 2.05.30, 2.05.3(2), and 4.01
The general description of the mining operations and facilities have been
reviewed by the Division. Concerns raised during the preliminary adequacy
review.about production figures, extent of underground workings and the
construction of mine facilities were satisfactorily resolved by the
applicant. The general description of the mine operations can be found on
pages 2.05-1 through 2.05-10 in Volume I of the application.
CF&I Steel Corporation intends to continue mining at the rate of 1,000,000
tons per year during the 5 year term of this permit. The total disturbance
during this permit term will be 155 acres. A total of 10,000,000 tons of coal
will be removed by the operation during the 10 year remaining mine life.
The operation is in compliance with the requirements of this section.
XVI. Explosives - Rules 2.05.3(6) and 4.08
The requirements of this section do not apply to this operation, since no
explosives will be used at the surface.
XVII. Backfilling and_Grading - Rules 2.05.3(9), 2.05.4(2)(a),
Information on backfilling and grading can be found in Volume I pages 2.05-26
through 2.05-29, maps 15 and 16 of Volume IV, and the Draft Findings response
of December 20, 1982. These sections have been reviewed by the Division for
compliance with the Regulations.
