<br />-55- <br />Pursuant to Rule 2.07.6(2)(n) and on the basis of available information, the <br />Division finds that the operation will not affect the continued existence of <br />endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats. <br />The Division finds the operation in compliance with the requirements of this <br />section. <br />XIV. Prime Farmland - Rules 2.04.12, 1.06.6 and 4.25 <br />Section 2.04.12 of Volume I and Exhibit 14 of Volume II of the application <br />contain information pertinent to Prime Farmlands. <br />The applicant has supplied documentation from the Sail Conservation Service <br />(USDA) stating that there are no prime farmlands in the vicinity of the mine. <br />Although a soil series (Tobin Silty Clay Loam) was pre v5ously identified as <br />prime farmland, the short growing season of the region and poor capability <br />class rating of the soil excludes it from this classification. <br />Pursuant to 2.07.6(2)(k) and on the basis of documentation provided by the <br />applicant, the Division has determined that no prime farmlands exist within <br />the permit area. <br />XV. Operations Description - Rules 2.05.2, 2.05.30, 2.05.3(2), and 4.01 <br />The general description of the mining operations and facilities have been <br />reviewed by the Division. Concerns raised during the preliminary adequacy <br />review.about production figures, extent of underground workings and the <br />construction of mine facilities were satisfactorily resolved by the <br />applicant. The general description of the mine operations can be found on <br />pages 2.05-1 through 2.05-10 in Volume I of the application. <br />CF&I Steel Corporation intends to continue mining at the rate of 1,000,000 <br />tons per year during the 5 year term of this permit. The total disturbance <br />during this permit term will be 155 acres. A total of 10,000,000 tons of coal <br />will be removed by the operation during the 10 year remaining mine life. <br />The operation is in compliance with the requirements of this section. <br />XVI. Explosives - Rules 2.05.3(6) and 4.08 <br />The requirements of this section do not apply to this operation, since no <br />explosives will be used at the surface. <br />XVII. Backfilling and_Grading - Rules 2.05.3(9), 2.05.4(2)(a), <br />Information on backfilling and grading can be found in Volume I pages 2.05-26 <br />through 2.05-29, maps 15 and 16 of Volume IV, and the Draft Findings response <br />of December 20, 1982. These sections have been reviewed by the Division for <br />compliance with the Regulations. <br />
