<br />-20- <br /> <br />NEEDED TO MEET EFFLUENT LIMITATION FOR THESE AREAS IN ACCORDANCE WITH <br />RULE 4.05.2(3. IN ADDITION, THE PERMITTEE MUST DESCRIBE WHAT <br />ACTIVITIES OVER THE NEXT FIVE YEARS WILL OCCUR IN THE WEST AREA, AND THE <br />LOCATION AND DESIGNS OF DITCHES AND CULVERTS USED TO ROUTE RUNOFF WATER <br />TO THE RIVER. THIS PLAN WILL 8E SUBMITTED AS A REVISION TU THE PERMIT. <br />Inspections by the Division have shown that sediment ponds 006 and 007 often <br />contain runoff water. Sediment pond 005 occasionally contains runoff water, <br />and sediment pond 004 rarely contains runoff water. To the Divisions <br />knowledge, sediment ponds 004 and 005 have never required cleaning and in <br />general receive very little sediment. Sediment ponds 006 and 007 do <br />occasionally require sediment cle~anout. These ponds must be marked with a <br />staff gage indicating the sediment cleanout level. The applicant has not <br />committed to this, therefore, the following stipulation is necessary: <br />Stipulation No. 5: <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE PERMITTEE SHALL INSTALL STAFF <br />GAGES IN SEDIMENT PONDS 006 and 007 THAT INDICATE THE LEVEL OF SEDIMENT <br />STORAGE VOLUME AS A PERCENTAGE OF THE TOTAL SEDIMENT STORAGE VOLUME. <br />The impact of discharge from the sediment ponds on the Purgatoire River is <br />predicted to be minimal. Very little data on the quality and quantity of the <br />pond discharge waters have been submitted. The data submitted is NPDES <br />monitoring reports which contain analyses for only sediment pond 007 which <br />discharged twice during the period of record. It appears that additional <br />NPOES monitoring records may be available. Additional infottnation is <br />necessary to verify the conclusion that the impacts of sediment pond discharge <br />will be minimal. Therefore, the following stipulation is necessary: <br />Stipulation No. 6: <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST REVISE THE PERMIT <br />APPLICATION TO INCLUDE ALL PERTINENT INFORMATION ON DISCHARGE FROM THE <br />SEDIMENT CONTROL PONDS. <br />Further discussion on the impacts of the operation on surface water quality <br />and quantity is presented in Section VII of this document, entitled Probable <br />Hydrologic Consequences of Mining and Cumulative Hydrologic Impact Study. <br />Division requirements for continued monitoring of surface waters during <br />operation are also included in Section UII. <br />With the acceptance of the stipulations in this section, the proposed <br />operation is in compliance with surface water requirements. <br />VI. Hydrologic Balance: Ground Water - Rul <br />Exhibit 6 of Volume I, Exhibit 9 of Volume II, and CF&I's responses to the <br />Division's draft findings document were reviewed by the Division for <br />compliance with the above sections of the Colorado Rules and Regulations. <br />Data provided by the applicant is sufficient to make the following findings <br />with Stipulations. <br />
