III IIIIIIIIIIIIIIII <br />999 <br />ENERGY, IIVC. <br />~ sne:iamy o/ <br />DerrKl GenmGOn i <br />TmiuiniQbn Cooppmive <br />March 29, 2001 <br />Mr. Dan Mathews <br />Division of Minerals and Geology <br />2148 Broadway, #C-5 <br />Grand Junction, CO 81503 <br />RE: Relevant showing c <br />comply with Section <br />of the Colorado M <br />*REVISION 4* <br />Dear Dan: <br />f road construction, design and maintenance to <br />4.03.](d)(ii) and 4.03.2(1)(f)(ii) of the Regulations <br />ned Land Reclamation Board for Coal Mining. <br />The purpose of this letter is to provide a relevant showing that the herein mentioned <br />travelways that meet the DMG's definition of Road, as described in Section 1.04(111), <br />meet the performance standards of 4.03.1 and 4.03.2. <br />Evidence will not be presented for improvement work on Rio Blanco County Road 65 as <br />it is and always has been a public road since the issuance of this permit and consequently <br />is specifically excluded from DMG's definition of "Road" as described in Section 1.04, <br />definition (111). <br />Refuse Haul Road <br />The Refuse Haul Road was designed before Colorado gained primacy for surface <br />inspection and therefore the original design and reference standards aze from 30 CFR part <br />817. The referenced standards have also been renumbered since that time. To move <br />forward in time to the present, the appropriate Federal standards appear now to be 30 <br />CFR 817.150 and 817.151. The corresponding CMLRB standard is 4.03.1. <br />Through research of the design drawings, verbiage in the Permit documents, maintenance <br />history, and visual inspection the refuse haul road appears to be in substantial compliance <br />with the provisions of Rule 4.03.1. <br />More specifically the design, location, width and visible surface construction were all <br />considered for the use of two 35 ton dump bed haul trucks or trucks of similar design. <br />Through witnessing the performance of the road over the past fifteen years, it appears <br />that the construction of the road has met the design criteria. The road has experienced no <br />sloughing or structural damage and has only had a minimum of soft spots even through <br />the worst of weather. <br />The drainage structures were constructed and have been maintained in accordance with <br />the Rule. The surface of the road consists of crushed gravel and is maintained on a <br />continuing basis.
