~~~
July 17, 2003
Jim Bender
Rd. 5467 #31
Farmington, NM 87401
Dear Mr. Bender:
J{f~,
A~ ~
>~'uis~n o ~~ ~l
M;,~~rdJ ~ ~ a ~Y
You have asked whether La Plata County would consider allowing the structure approved for the Incas
Mine (our project #94-171) to be considered a permanent building. I have reviewed our project file and
meeting minutes and can find no reference to the structure as a temporary building or any County
requirement to remove the structure and reclaim the site when mining ceases. I have also met with the
County Building Director who expressed no concerns. Based on the above information, the County
Planning Department has no concern with a revision to your Mining permit to consider the structure
"permanent."
Please remember that the only permitted use of the structure is in conjunction with the mining operation.
Should the mining operation cease, the structure would be required to remain vacant until another use was
specifically approved. Given the remote nature of the structure, it is likely that no other uses would be
approved. I apologize for the long delay in responding to your request. Please feel free to contact me at the
address below if you have any additional questions or concerns.
Sincerely,
Nancy D. Lawo
Planning Director
