i • • <br />Attachment A of Federal Permit CO-0002 Termination, December 1988 <br />Conditions of Mining Plan Approval <br />Page 1 of 4 <br />CONDITIONS <br />OF <br />MINING PLAN APPROVAL <br />This document contains the aoolicable conditions of approval of the Marr <br />Stria mine mining play approved on Harch 3, 1981, for Federal coal lease <br />C-22777. Kerr Coal Company is hereinafter referred to as the lesseeloperator. <br />Condition 1. Statutes and Regulations. -She mining plan approval was made <br />pursuant to Federal coal 12ase C-22777; the Mineral Leasing <br />Act of 1920, as amended (30 U.S.C. 181 et seg.); and in the <br />case of acquired lands, the Mineral Leasing Act for Acquired <br />Lands of 1947, as amended (30 Q.S.C. 351 et sew.). The <br />mining plan approval is subject to all aoolicable regulations <br />of the Secretary of the Interior including, but not limited <br />to, 30 CFR Chapter VII and 43 CFR Group 3400, and to all <br />regulations of the Secretary bf Energy, which are now or <br />herear'ter in force; and all such regulations are made a part <br />hereof. The lessee/operator shall comply with the provisions <br />of the Water Pollution Control Act (33 U.S.C. 1151 et sew.), <br />the Clean Air Act (42 U.S.C. 7401 et ~.) and other <br />applicable Federal laws. <br />Condition 2. The current mining plan approved on Harch 3, 1981, covers all <br />or portions of Federal coal lease C-22777 as described below: <br />T 9 N. , R 78 W <br />Section 22: E1/2, E1/2NW1/4 <br />Section 23: SWI/4SW1/4 <br />Section 26: NW1/4, E1/2SW1/4NE1/4, N1/2SW1/4, SE1/45W1/4, <br />W1/2NW1/45E114 <br />Section 27: NE1/4NE1/4NE1/4 <br />as shown on the map appended hereto as Exhibit A. <br />Condition 3. The lessee/operator shall conduct coal development and mining <br />operations only as described in the complete permit <br />application package approved by the Colorado Mined Land <br />Reclamation Division, except as others+ise directed in the <br />conditions of the mining plan approval as contained herein. <br />Condition 4. The lessee/operator shall comply with the terms and <br />conditions of the lease and the approved mining plan, and the <br />requirements of the Colorado Permit number C-80-006 issued <br />under the Colorado State program, approved pursuant to the <br />Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. <br />1201 et s_g.). <br />
