Box 435 ~~~ 1~ l <br />Durango, CO 81302 <br />Dear Mr, Butler: <br />~~ <br />~~ <br />~~ i <br />3809 (170) <br />CO-016-N-82-5 <br />RECEIVED <br />DEC 151989 <br />MINED LAND <br />RECLAMATION DIVISION <br />In response to your notice dated November 29, 1989 and our field <br />inspection pertaining to recent upgrading your access road into Juniper <br />Mountain, we have determined this activity to constitute unnecessary and <br />undue degradation. This determination is primarily based on the fact that <br />no justification has been provided to this office that demonstrates the <br />need for this route to be upgraded at this time. Therefore you will be <br />required to rehabilitate the upgrading measures back to the 10 foot width <br />agreed upon in our letter dated September 1, 1989 unless you provide this <br />office with sufficient written justification. If insufficient <br />justification is provided the rehabilitation work will be required no later <br />than June 1, 1990. <br />Lle have now calculated the total level of surface disturbance associated <br />with your activities under tJotice CO-016-N-82-5 to be approximately 4.3 <br />acres including the upgraded road. The regulations only allow Notice level <br />activities to cause a cumulative surface disturbance of 5 acres or less <br />during any calendar year. Since your activities are close to the allowable <br />level of surface disturbance, we suggest that no further surface disturbing <br />activity take place without reclaiming some of the existing disturbance or <br />filing a plan of operations pursuant to 43 CER 3809.1-4 with this office. <br />As a reminder, the 1872 t4ining Law only applies to locatable minerals and <br />those minerals with exceptional qualities for specific uses. t7ater;.a1_s <br />used for common purposes that require no special qualities are disposable <br />under the Ptaterial Sales Act and a contract for sale is required. <br />Your cooperation ~ii11 be appreciated, <br />Sincerely, <br />Glen tJ.
