<br />-3- <br />stability analyses as necessary. Development of the leach facility may not proceed beyond <br />the foundation preparation phase until the leach pad configuration has been demonstrated <br />to be stable, and has been accepted by the Office. <br />13. Design and specification changes, as defined in Section 6.05 of the COA plan and technical <br />specifications, shall only be made with written agreement from the Office. <br />14. All certification reports and as-built drawings will be submitted to the Office for review and <br />acceptance within five working days of such reports and drawings becoming available to <br />the operator. <br />15. The frequency of permeability testing for soil liner fill will be one test for each 5000 cubic <br />yards of fill until such time that the office approves a lower frequency for testing. Such <br />approval would be based upon a demonstration of consistency in the initial results. <br />16. All underdrain fill materials must be durable and chemically inert, and must meet the <br />gradation defined in the technical specifications, If any underdrain fill materials or soil liner <br />materials that have been placed are shown to be acid or toxin generators by the ongoing <br />or future geochemical evaluations acceptable to the Office, such materials must be <br />completely removed, properly disposed of, and replaced with acceptable fill. The technical <br />specifications included int the operator's February 28, 1994 submittal (Volume VI, <br />Appendix E) constitute enforceable permit parameters. <br />17. The operator will provide the results of the long-term metals leaching and acid generation <br />tests before any of the material from the additional test area is loaded on the leach pad or <br />placed in the waste rock storage area. The Carlton tailings must be tested for cyanide, <br />metals leaching and acid generation prior to material disturbance. A report delineating the <br />test results will be submitted to the Office within ten working days of receipt of the results <br />by the operator. If the Office determines that the generation and release of acid and/or <br />metals has the potential to violate applicable water quality standards for surface water or <br />jeopardize the existing or potential future uses of groundwater, the operator will propose <br />to the Office measures that will protect the receiving waters from non-compliant releases. <br />Such. proposal will be in the form of a permit modification and will be submitted to the <br />Office within 30 days of notification. <br />18. The operator will submit to the Office the results of rinsing of materials leached in an <br />experimental vat leach. Said results shall include the rinsate volumes, compositions, and <br />analyses of free cyanide, WAD cyanide, total cyanide, all metals currently regulated under <br />water quality discharge permits, sulfate, nitrate, and nitrite. Such tests must demonstrate <br />rinsing efficiency adequate to reduce WAD cyanide, and metals, sulfate, nitrate and nitrite <br />concentrations to levels below water quality standards established for the receiving <br />streams. Provided said rinsing is unable to meet water quality standards, the operator will <br />propose a method acceptable to the Office to achieve arinsate/leacheate that meets <br />applicable water quality standards within 90 days from the date such tests are furnished <br />to the office. Said tests will be completed and results furnished to the Office within one <br />year following approval of Amendment No. 6. <br />
