Box 1821 <br />Colorado Springs, CO 80901 <br />Re: GEC Minerals Strip, Revoked Permit No. C-81-037 <br />Dear Dr. Corley: <br />As you are aware, the Division of Minerals and Geology through its contractor is performing <br />reclamation mandated by the Colorado Surface Coal Mining Reclamation Act at the forfeited <br />GEC Minerals site. The contractor is currently performing work in the Orphan Pit area of <br />the site. The next phase of the reclamation project will occur in the Section 30 area. I <br />understand that you have reviewed and commented on the reclamation specifications, and <br />have attended the pre-bid meeting when the reclamation project was discussed in the field <br />with prospective contractors. <br />It has come to my attention that, as of October 14, 1993, the lock which the Division of <br />Minerals and Geology Inactive Mines Program had installed on the Section 30 gate to allow <br />contractor access has been removed. I also understand that you have stated that you will not <br />allow the State of Colorado through its contractor to access the Section 30 project area until <br />certain unspecified demands are satisfied. <br />The Division is performing its statutory duty to perform rechrmation at this forfeited site. <br />You have previously requested that the Mined Land Reclamation Board order the Division to <br />perform this work. The Board honored your request, and entered such an order. The <br />Division has taken numerous opportunities to solicit your input into the rechunation planning <br />process, and has incorporated your ideas to the extent it was able. For example, you have <br />suggested a substantial design change for the West Pit drainage. The scope of the change <br />deviates significantly from that which was approved in our Agreement. We have reviewed <br />the proposal, and added appropriate engineering detail. Your suggested change enhances the <br />reclamation plan for this area, and therefore the Division would like to implement this <br />design. However, this will require a modification to the Agreement. The Division will draft <br />a modification and send it to you for your approval. If you do not approve, the Division will <br />construct the West Pit drainage to the specifications which you submitted in support of the <br />Agreement last spring. <br />
