Box 1821 Colorado Springs, CO 80901 Re: GEC Minerals Strip, Revoked Permit No. C-81-037 Dear Dr. Corley: As you are aware, the Division of Minerals and Geology through its contractor is performing reclamation mandated by the Colorado Surface Coal Mining Reclamation Act at the forfeited GEC Minerals site. The contractor is currently performing work in the Orphan Pit area of the site. The next phase of the reclamation project will occur in the Section 30 area. I understand that you have reviewed and commented on the reclamation specifications, and have attended the pre-bid meeting when the reclamation project was discussed in the field with prospective contractors. It has come to my attention that, as of October 14, 1993, the lock which the Division of Minerals and Geology Inactive Mines Program had installed on the Section 30 gate to allow contractor access has been removed. I also understand that you have stated that you will not allow the State of Colorado through its contractor to access the Section 30 project area until certain unspecified demands are satisfied. The Division is performing its statutory duty to perform rechrmation at this forfeited site. You have previously requested that the Mined Land Reclamation Board order the Division to perform this work. The Board honored your request, and entered such an order. The Division has taken numerous opportunities to solicit your input into the rechunation planning process, and has incorporated your ideas to the extent it was able. For example, you have suggested a substantial design change for the West Pit drainage. The scope of the change deviates significantly from that which was approved in our Agreement. We have reviewed the proposal, and added appropriate engineering detail. Your suggested change enhances the reclamation plan for this area, and therefore the Division would like to implement this design. However, this will require a modification to the Agreement. The Division will draft a modification and send it to you for your approval. If you do not approve, the Division will construct the West Pit drainage to the specifications which you submitted in support of the Agreement last spring.
