BEFORE THE MINED LAND RECLAMATION HOARD, STATE OF COLORADO <br />ZN THS NATTER OF THE PERNIT RENEWALS FOR BASIN RE30DRCES, INC. FOR <br />THE NSW SLR NINE (PERMIT NO. C-81-012) AND GOLDEN EAGLE MINE <br />(PERMIT NO. C-81-013) <br />REQDSST FOR PIIBLIC HEARING <br />Basin Resources, Inc., 14300 Highway 12, Weston, Colorado <br />81091 (Basin), is a permittee under the Colorado Surface Coal <br />Mining Reclamation Act. Basin operates the New Elk Mine under <br />terms of Permit C-81-012, and the Golden Eagle Mine under terms of <br />Permit C-81-013. The permits expire on January 25, 1994, and the <br />Division of Minerals and Geology (Division) is completing the final <br />process of review prior to issuing a proposed decision on renewal <br />of the permits. <br />Basin requests a formal hearing before the Board on issues <br />relating to renewal of the referenced Permit Nos. C-81-012 and <br />C-81-013. This;. request is made. .pursuant to 2 CCR.407-2, § 2.07.4. <br />Basin..is : a .persoip;:3auider the _.Boa~dfs roles, eligible: ,to request a <br />hearing on the>proposed decision of the Division: Basin may be <br />adversely impacted by the Division's proposed decision. <br />Basin requests that the Board grant Basin's request for <br />temporary relief, also pursuant to § 2.07.4(3)(d), at its next <br />regularly scheduled hearing on January 26, 1994. Basin requests <br />that the Board allow Basin to continue operations at the subject <br />mines pending final determination and action on the permit <br />renewals. Granting temporary relief in this manner will facilitate <br />full administrative review of the proposed decision of the <br />Division, while avoiding a temporary shutdown of mining operations <br />at the New Elk and Golden Eagle !Sines. <br />Basin has previously submitted a Petition for Declaratory <br />Order (Petition) to this Board, relating to the same matter. Basin <br />requests that the Memorandum in support of that Petition, which <br />contains information that will be helpful to the Board in <br />considering this request, be incorporated into this Request as <br />well. <br />
