<br />Seneca Coal Company submitted the original application for a new permit on November 16, <br />1994. The application was deemed complete on November 21, 1994. By March 10, 1995, the <br />Division had received comments from all the required agencies and entities and issued the permit <br />effective August 5, 1995. <br />Haul road construction began at the mine site shortly before the first Division inspection, which <br />occurred on August 18, 1995. In mid-August 1996, the operator began stripping topsoil at the <br />first pit. The dragline was moved in in late October through eazly November of 1996 and actual <br />mining operations commenced shortly thereafrer. <br />Section II -History of Violations <br />NOV C-96-015 <br />was written 7-18 -96 for failure to describe, design, and submit for an approval an access road <br />and an electrical substation prior to construction; and failure to pass drainage from substation pad <br />to a pond as approved by the permit. <br />NOV C-96-016 <br />was written 7-31-96 for failure to describe the light-use road leading to Topsoil Pile D; failure to <br />design the light-use road leading to Topsoil Pile D and to submit plans for approval prior to <br />construction. <br />NOV C-96-017 <br />was written 8-30-96 for failure to conduct mining operations within the approved permit area, <br />implementing revisions prior to approval, failure to provide specifications and geotechnical <br />analysis on a road cut, and failure to provide a reclamation plan. (Vacated). <br />NOV C-96-018 <br />was written 8-30-96 for failure to conduct mining operations within the approved permit azea and <br />implementing a revision prior to approval. <br />NOV C-97-003 <br />was written 3-19-97 for failure to pass disturbed azea runoff through a sediment pond before <br />leaving the permit area. <br />NOV C-97-004 <br />was written 3-19-97 for failure to minimize disturbance of prevailing hydrologic balance, failure <br />to prevent additional contributions of suspended solids to streamflow outside the permit area, <br />failure to construct haul road relief drains per the approved designs and failure to implement <br />temporary erosion control measures in lieu of completion of relief drains. <br />NOV C-97-O17 <br />was written ] 0-6-97 for exceedence of the maximum allowable weight of explosives to be <br />detontated in any one 8-millisecond interval. <br />
