Mine No. 3; Midterm Findings <br />conduct a Bond release inspection until June 18, 1998. The bond release is under review <br />with several adequacy concerns presented to the operator by the Division before a <br />proposed decision can be rendered. <br />No enforcement actions have been issued for Mine 3 in the past five years. <br />II. Revisions to the Permit: <br />Three minor revisions and one technical revision have been approved since the previous <br />permit renewal. <br />Minor Revision No. 19 was approved on October 10, 1995. This revision updated Map <br />4a to the permit required by Stipulation No. 21. Reclamation liability was unaffected by <br />this revision. <br />Minor Revision No. 20 was approved on May 30, 1996. This revision updated ownership <br />and control sections of the permit. Reclamation liability was unaffected by this revision. <br />Minor Revision No. 21 was approved on June 27, 1997. This revision updated ownership <br />and control sections of the permit. Reclamation liability was unaffected by this revision. <br />Technical Revision No. 8 was approved on July 18, 1997. This revision provided for <br />retention of the Middle Creek office and yazd azea in support of the post-mining land use. <br />This revision also eliminated the requirement of a woody plant density standazd for <br />reclamation success. TR-08 reduced the Mine No. 3 reclamation liability by <br />$129,678.00. The remaining reclamation liability for the mine after approval of TR-08 <br />was $70,322.00. Colorado Yampa Coal Company did not submit a replacement bond in <br />response to the reduced liability. DMG currently holds a bond in the amount of <br />$200,000.00. Stipulation No. 22 was attached to the Mine No. 3 permit upon approval of <br />TR-08. <br />III. Stipulations: <br />Stipulation No. 20 was resolved by submittal of information involving the Pittston <br />Injunction. Information was provided by Twentymile Coal Company on September 20, <br />1996. Twentymile Coal Company is a sister corporation owned and controlled by the <br />same parent company that owns and controls Colorado Yampa Coal Company. <br />Stipulation No. 22 was added to the permit as a result of TR-08. Stipulation No. 22 <br />required that Colorado Yampa Coal Company incorporate the remaining topsoil pile, T-1, <br />at the Middle Creek Office azea into the Foidel Creek Mine permit. Topsoil pile T-1 <br />would be designated for distribution at the Fish Creek Tipple. Foidel Creek permit would <br />accept the reclamation costs associated with transport of the soil resource to the tipple. <br />Twentymile Coal Co. submitted TR 98-31 on August 21, 1998, for the Foidel Creek <br />Permit, C-82-056. A portion of this revision addresses incorporation of the topsoil pile <br />
