y <br />Findings of the <br />Colorado Mined Land Reclamation Division <br />for the <br />Hayden Gulch Mine <br />Bond Release Application <br />Procedures for Seeking Release of Performance Bond (Rule 3.02.2) <br />The Division finds that, based on the review process history, the <br />requirements for seeking release of performance bonds as set forth in <br />Rule 3.03.2 have been met. Copies of written notices as required by Rule <br />3.03.2(1)(a) have been submitted to the Division. Proof of publication <br />in accordance with Rule 3.03.2(1)(b) has also been submitted. A site <br />inspection was held October 13 and 14, 1487, in accordance with Rule <br />3.03.2(2). <br />II. <br />Criteria and Schedule for Release of Perforrance Bonds <br />Phase I - Rule 3.03.1(2)(a) states that "up to FO percent of the tota} <br />bond amount applicable to an increment or permit area may be released <br />when the permittee successfully completes backfilling, regrading and <br />drainage control in accordance with the approved reclamation plan." <br />Certified maps of the post-mining topography have been suhmitted by the <br />operator. The area has been backfilled and graded in accordance with the <br />approved plan. Field investigations by the Division have verified slope <br />gradients. In general, the slopes were regraded to insure stahility. An <br />area of approximately five acres located in the SW 1/4 of Section 31, _ <br />T5N, R88W experienced some differantial settling in the spring of 1987. <br />The area was regraded, topsoiled and seeded prior to the October 13, 1987 <br />inspection and it appeared to be stable. Sufficient funds will be <br />available to cover any necessary maintenance work. A11 spoil piles, <br />highwalls and depressions have been eliminated. In addition, monitoring <br />data indicates that the backfilled material has heen placed to minimize <br />adverse effects on ground water and leaching of toxic materials. The <br />Division finds that the requirements of Rule 4.14.1(2) have been met. <br />The Division finds that the applicable regraded areas meet the <br />requirements of Rule 4.09 for excess overburden fills. This is based on <br />the required engineer certifications and field inspections by the <br />Division. <br />Drainage control has been accomplished at all sites in compliance with <br />the approved plan. All reclaimed and reestablished channels appear to be <br />stable. <br />The Division is recommending that FO percent of the bond covering the <br />mine site and facilities area be released. Sufficient money will remain <br />to conduct all remaining reclamation. <br />
