Director <br />October 19, 1987 <br />Mr. Jim Lunan <br />Peabody Coal Company <br />1300 South Yale <br />Flagstaff, Arizona 86001 <br />Re: Seneca II-W; Permit No. C-82-057 <br />Dear Mr, Lunan: <br />With the recent change in lead responsibility for this mine, I have reviewed <br />the entire permit document and files. Also, I have had some lengthy <br />conversations with Mr, Steve Renner. Based on all of this, I feel I have a <br />good understanding of this permit. The purpose of this letter is to discuss <br />rationale for placing the Seneca II-W into temporary cessation. <br />Rule A,30,1 discusses the requirement for temporary Cessation if mining and <br />reclamation operations have ceased for more than 30 days. The record reveals <br />that, in the technical sense, mining activities have never commenced since <br />permit issuance of December 31, 1985, Since the 30 day period has been <br />exceeded, temporary cessation should be applied for, <br />In discussions with Mr. Renner, there appears to be some apprehension based on <br />the various revisions that were applied for when the.Nucla Mine came out of <br />temporary cessation. Technical Revision No. 1 was applied for primarily <br />because of the change in mining methodology from draglines to scrapers and <br />dozers; Permit Revision No. 1 was applied for to bring into the mine plan <br />additional mining areas (specifically Areas 2, 3 and 5). The various <br />revisions submitted for the Nucla Mine were not directly related to temporary <br />cessation but to a need for Peabody to modify the entire plan based on new <br />requirements from Colorado-Ute, If the mine was active, these two revisions <br />would still have been necessary. <br />Placing the Seneca II-W Mine into temporary cessation does not infringe upon <br />any of the rights that Peabody would enjoy if the mine was active. The <br />primary purpose is to allow the Division to reduce the required inspection <br />frequency (see Rule 5.02,2).
