I <br />apologize for any problems in communication with the Division, but <br />most of this could have been handled in a phone conversation as we <br />did earlier today. <br />As far as the construction of pond 10, we started stripping topsoil <br />on July 24th. That morning Chuck McCulloh, our construction <br />foreman, notified me that we should have our geotechnical <br />consultant come out and take a look at the proposed site. Mr. Brian <br />Len, P.E. of Northwest Colorado Consultants (NWCC) arrived and we <br />both conducted an inspection of the dam site. Based on our field <br />investigation, Brian prepared the enclosed letter with his <br />recommendations for this project to proceed. I would like to point <br />out that NWCC prepared the Geotechnical Investigation, Attachment <br />13-5, which is contained in the permit package. Since the 24th, <br />Brian has personally inspected the site three times and has had his <br />field technicians here once or twice daily doing compaction <br />testing, soil sampling, etc. With the exception of the week I was <br />on vacation, when all we did was push topsoil and start <br />construction of the keyway, I have visited the site at least once <br />or twice per day. Finally, Chuck has been present at the site the <br />entire time. <br />As far as the keyway and embankment material, it is coming from <br />haul road cut material between stations 13+00 and 15+00 of haul <br />road "B" and not the facilities area. Any drainage from this area <br />is following the plans for the haul road itself. All soil testing, <br />laboratory information, stability analysis, etc. is being performed <br />by NWCC. As we mentioned on the telephone all geotechnical work <br />associated with the construction of pond 10 will be included as an <br />Appendix to the As-Built report. With regard to the horizontal <br />drainage system, based on Brian's recommendations we have "beefed <br />up" what is actually approved and contained in the design report. <br />Seneca Coal Company • P.O.
