Gunnison No. <br />1 Mine are submitted to you in response to Colorado Mined Land Reclamation <br />Division Stipulation No. 7 and the Office of Surface Mining Stipulation No. 3 <br />requiring that "within six months _of the permit issuing, the applicant shall <br />demonstrate that tTie mining operations' fresh water usage would not materially <br />carnage the quantity and quality of those waters supplying alluvial valley floors". <br />These stipulations were pact of the permits granted by the CMtRD and the OSM <br />earlier this year for the Mt. Gunnison No. 1 Mine near Somerset, Colorado. The <br />permits were issued pursuant to the Colorado Surface Coal Mining and Reclamation <br />Act of 1979 and the Federal Surface Mining Control and Reclamation Act of 1977. <br />The response corrects and clarifies erroneous assumptions contained in the TEA. <br />The Cumulative Hydrologic Impact Study stated that the worst case water use <br />scenario would be 224 acre feet per year use of spraying coal and 150 acre feet per <br />year for potable water supply. In fact, the worst case projected water use is 150 <br />acre feet per year for total mine water use. Even though the TEA estimated that <br />fresh water would be 250 percent of the actual projected use, it concluded in the <br />mass balance analysis of the Cumulative Hydrologic impact Study that "the net <br />impact to downstream users should be minimal -assuming ARCO provides adequate <br />storage for water to be used during dry months". The assessment contained in the <br />enclosed revised pages of the Mt. Gunnison No. l Mining and Reclamation Plan <br />clearly demonstrates that there is no risk of material damage to the quantity and <br />quality of water supplying the AVF on the North Fork of the Gunnison associated <br />with fresh water use and discharge at the Mt.
